Common questions

Who pays after an Uber or Lyft accident, the company or the driver?+

It depends on what the driver was doing the moment the crash happened. If the app was on and a passenger was in the car, Uber or Lyft's $1 million insurance policy usually applies. If the app was off, the driver's personal auto insurance applies. Peretz Law Firm determines which policy covers you.

Can I sue Uber or Lyft directly?+

In most cases you file a claim against Uber or Lyft's insurance rather than suing the company itself, but the result is the same, you recover money from the rideshare company's policy. Peretz Law Firm handles that claim for you.

I'm a rideshare driver who got hit. Am I covered?+

Yes. If you were logged into the Uber or Lyft app when another driver hit you, the rideshare company's insurance generally covers you when that driver was at fault. Peretz Law Firm represents rideshare drivers as well as passengers.

How long do I have to file a rideshare accident claim?+

The deadline to file a rideshare accident lawsuit is generally two years from the date of the crash in Pennsylvania and New Jersey, and three years in New York. Report the crash in the app right away and call a lawyer before you speak with any insurance adjuster.
